1. About these Terms
These Terms and Conditions ("Terms") govern your use of the Elite Offshore Academy website (eliteoffshoreacademy.com) and any training programmes you enrol in. By accessing our website, requesting course information, paying a fee, or enrolling in a course, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use our website or enrol in our courses.
2. Who We Are
Elite Offshore Academy ("EOA," "we," "our," or "us") is a marine, offshore, and industrial training provider operating from Mumbai, India. We are MLC 1.3 and 3.2 compliant, ISO 9001 (ABS) compliant, and ISO 21001 (TUV NORD) certified.

3. Definitions
• "EOA," "we," "our," "us" — Elite Offshore Academy.
• "You," "your," "Candidate" — the individual enrolling in or completing a course, or any person otherwise using our website.
• "Course" — any training programme listed on our website, whether delivered online or in person.
• "Certificate" — the certificate of proficiency or completion issued by EOA on successful completion of a course.
• "Fees" — the tuition or course fees payable for a course.
• "Website" — eliteoffshoreacademy.com and any related EOA web property.
• "Services" — collectively, our courses, certificates, the verification portal, and our website.
4. Eligibility and Enrolment
To enrol in any EOA course you must:
• Be at least 18 years of age.
• Meet any prerequisites stated on the relevant course page (sea-time, qualifications, supporting certifications, etc.).
• Provide true, complete, and current information when enrolling.
• Provide supporting documents on request — including but not limited to service records, medical certificates, academic certificates, and identification.
We reserve the right to refuse, suspend, or cancel an enrolment if you do not meet the prerequisites, fail to provide requested documentation, or provide false or misleading information. Misrepresentation of prerequisites or identity is grounds for cancellation without refund and may result in subsequent revocation of any certificate issued.
5. Fees and Payment
Course fees are stated on each course page in Indian Rupees (INR). Any equivalent USD or other currency figures shown are indicative only and subject to prevailing exchange rates at the time of payment.
Unless otherwise agreed in writing, fees are due in full before the course start date. We accept payments via RazorPay and other payment service providers; payment processing is subject to the relevant provider's terms.
Taxes: Goods and Services Tax (GST) and any applicable foreign taxes are payable by you in addition to the listed fees, unless explicitly stated otherwise.
We may revise our fees at any time; the fee in effect on the date of your enrolment confirmation governs your cohort.
6. Cancellation, Refunds and Rescheduling
Our cancellation and refund policy is set out in detail in our separate Cancellation and Refund Policy page, which forms part of these Terms by reference. The key principles are:
• Cancellation by you, more than 14 days before the course start date — full refund of fees paid, less any payment-gateway charges.
• Cancellation by you, 7 to 14 days before the course start date — partial refund (see the Cancellation and Refund Policy for the specific percentage).
• Cancellation by you, less than 7 days before the course start date, or no-show — no refund. You may be offered the option to reschedule, at our discretion and subject to an administrative fee.
• Cancellation or rescheduling by us — full refund or rescheduling to a future cohort at no additional cost. We will not be liable for any travel, accommodation, or other consequential costs you may have incurred.
• Refunds, where due, are processed within 14 to 21 working days through the original payment method.

7. Attendance and Conduct
To qualify for certification, you must:
• Attend all required sessions of your enrolled course.
• Follow instructor directions, safety procedures, and any site rules applicable to in-person courses.
• Conduct yourself professionally during the course and in any related online forums or communications.
We may remove a candidate from a course, without refund, for disruptive behaviour, dishonesty (including cheating in assessments), or any conduct that endangers the safety of others.
8. Assessment, Certification and Re-assessment
Certificates are issued only on successful completion of all required assessments — theory tests, practical assessments, or both, as specified for the relevant course.
If you do not meet the required assessment standard:
• Re-assessment may be available subject to the rules of the specific course and at an additional fee where applicable.
• If re-assessment is unsuccessful or unavailable, you may be required to re-attend the full course before re-assessment.
Issuance of a certificate is at EOA's discretion, subject to your meeting all course requirements and any applicable regulatory or accreditation requirements.
9. Certificate Validity and Renewals
Certificate validity varies by course and is stated on the relevant course page and on the certificate itself. Some certificates are valid for a fixed period (typically 5 years for OIM, MS, BCO, BS, and 2 years for the Offshore Crane Operator Stage 2 and Stage 3); others have no expiry (typically the Magnetic Compass Adjuster certificate, the Crane Inspector certificate, and the Offshore Crane Operator Stage 1 certificate).
Renewals and refresher training are subject to additional fees and may require updated documentation, including an updated medical or service record where applicable.
10. Certificate Authenticity and Revocation
Every EOA certificate carries a unique reference number and is independently verifiable online via our verification portal at eliteoffshoreacademy.com/verify-certificate.
We may revoke a certificate, with notice to you, if:
• You materially misrepresented your prerequisites, qualifications, or identity at the time of enrolment.
• The certificate was obtained fraudulently or through dishonest conduct during the course or its assessment.
• You are found, after issuance, to have engaged in misconduct that is materially relevant to the credential.
• A flag-state, classification society, or other competent regulatory authority directs revocation.
Where a certificate is revoked, we may inform the relevant flag-state authority, classification society, or accreditation body (including but not limited to LISCR, ABS, TUV NORD, and IMCA), and the certificate's online verification status will be updated to reflect revocation.
11. No Guarantee of Employment or Outcomes
Completing an EOA course and obtaining a certificate does not guarantee any job offer, offshore appointment, visa outcome, salary level, or any specific career outcome. Hiring decisions are made by employers in their sole discretion based on their own criteria. We make no representations about market demand for offshore roles in any region or at any time.
12. Intellectual Property
All course materials provided to you — including study guides, slides, recorded sessions, logbooks, templates, assessment papers, and any other course-related content — are the intellectual property of EOA or are licensed to EOA by third parties.
You may use these materials solely for your own personal training, reference, and professional development. You may not:
• Reproduce, redistribute, resell, or sub-license any course material.
• Use any course material to provide competing training or to develop competing materials.
• Remove any copyright, trademark, or other proprietary notice from any material.
13. Acceptable Use of the Website
When using our website, you agree not to:
• Attempt to gain unauthorised access to any part of our website or systems.
• Scrape, crawl, or systematically extract data from our website, including our verification portal.
• Use our verification system for any purpose other than legitimate certificate verification.
• Impersonate any other person or misuse another person's certificate identifier.
• Use the website in any way that violates applicable law.
14. Limitation of Liability and Disclaimers
To the maximum extent permitted by applicable law:
• EOA's total aggregate liability to you arising from or in connection with any course or any other Service is limited to the fees you actually paid to EOA for the relevant course.
• We are not liable for any indirect, consequential, special, incidental, or punitive damages — including loss of profits, loss of employment opportunity, lost wages, travel and accommodation costs incurred for a cancelled or rescheduled course, or any reputational damage.
• We provide our website and Services on an "as is" and "as available" basis, and we disclaim all warranties beyond those required by mandatory applicable law.
Nothing in these Terms limits or excludes any liability that cannot be lawfully limited or excluded — including liability for fraud, gross negligence, death or personal injury caused by negligence, or any non-waivable consumer protection.
15. Indemnification
You agree to indemnify, defend, and hold harmless EOA and its officers, employees, instructors, and contractors against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:
• Your breach of these Terms.
• Your misrepresentation of your credentials, identity, or any information provided to us.
• Your misuse of EOA course materials, website, or Services.
• Any third-party claim arising from your acts or omissions in connection with your use of an EOA certificate.
16. Force Majeure
Neither party will be liable for any delay or failure to perform under these Terms caused by events beyond its reasonable control — including but not limited to natural disasters, pandemics, war, civil unrest, government action, internet or telecommunications outages, or third-party service-provider failures.
Where a force-majeure event prevents us from delivering a course, we will either reschedule the course to a later cohort at no additional cost or refund the fees paid, at our discretion.
17. Privacy
Our collection, use, and disclosure of your personal information is governed by our Privacy Policy at eliteoffshoreacademy.com/privacy-policy. By using our website or enrolling in a course, you confirm that you have read and accepted that Policy.
18. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our practices, regulatory requirements, or operations. The "Last updated" date at the top of these Terms reflects the most recent revision. Material changes will be notified by email and on the website.
The version of these Terms in force at the time of your enrolment will continue to govern your enrolled cohort, even if these Terms are subsequently amended.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of India.
Any dispute, controversy, or claim arising out of or relating to these Terms — including their existence, validity, interpretation, performance, breach, or termination — will be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
[Lawyer note: an arbitration alternative (e.g., Mumbai-seated arbitration under the MCIA Rules) may be more efficient for cross-border disputes. A lawyer should advise.]
20. Severability, Assignment, and Waiver
• Severability: if any provision of these Terms is found by a court of competent jurisdiction to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed; the remaining provisions remain in full force.
• Assignment: you may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a business reorganisation or sale.
• Waiver: our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision in the future.
